Terms of Service

1. These terms

These Terms of Service (the "Terms") govern the use of the DineSpot platform — the website www.dinespot.si, the restaurant dashboard, and the hosted booking pages (together, the "Service") — operated by DineSpot, Kumrovškova ulica 11, 1000 Ljubljana, Slovenia ("DineSpot", "we"). By creating an account or using the Service you agree to these Terms.

2. The Service

DineSpot is a reservation management platform for restaurants. It includes, among other features, a reservation dashboard, a table and floorplan editor, a hosted online booking page, automated email and SMS notifications, and optional card-guarantee functionality for no-show protection.

3. Accounts

You must provide accurate information when registering and keep your credentials confidential. You are responsible for all activity under your account. Accounts are intended for businesses; by registering a company you confirm that you are authorized to act on its behalf.

4. Subscriptions, trials and billing

The Service is offered on paid subscription plans, billed in advance on a monthly basis. New accounts may include a free trial. If a subscription lapses or payment fails, access to the Service — including the online booking page — may be suspended until the subscription is restored. You can cancel at any time; cancellation takes effect at the end of the current billing period. Fees are non-refundable except where required by law.

5. Reservations and guests

Reservations made through the Service are agreements between the restaurant and its guests. The restaurant is responsible for honoring confirmed reservations, for the accuracy of its published information (opening hours, availability, contact details), and for handling its guests' personal data lawfully. DineSpot is not a party to the reservation and is not liable for no-shows, cancellations or disputes between restaurants and guests.

6. Card guarantees and no-show charges

Where a restaurant enables card guarantees, guest card details are processed by our payment provider Stripe. The decision to charge a guest for a no-show or late cancellation is made by the restaurant, which must disclose its no-show policy to guests and apply it fairly. The restaurant is responsible for any charge it initiates and for handling related disputes and chargebacks.

7. Acceptable use

You may not use the Service to violate any law, to send unsolicited communications, to upload malicious code, to probe or disrupt our infrastructure, to access other tenants' data, or to make fraudulent reservations. We may suspend or terminate accounts that breach these Terms.

8. Availability and changes

We aim to keep the Service available at all times but do not guarantee uninterrupted operation. We may modify, add or remove features, and will give reasonable notice of changes that materially reduce the Service's functionality. Features marked as beta are provided as-is and may change or be withdrawn at any time.

9. Intellectual property

The Service, including its software, design, structure and content provided by DineSpot, is and remains the property of DineSpot. You retain all rights to the data and content you upload (such as your logo and restaurant information) and grant us the license needed to operate the Service — for example, to display your logo on your booking page.

10. Data protection

Our processing of personal data is described in our Privacy Policy and GDPR page. For guest data collected through your booking page, you act as the data controller and DineSpot as your processor.

11. Liability

To the maximum extent permitted by law, DineSpot's aggregate liability arising out of or related to the Service is limited to the amount you paid for the Service in the twelve months preceding the event giving rise to the claim. We are not liable for indirect damages such as lost revenue or lost bookings. Nothing in these Terms limits liability that cannot be limited under applicable law.

12. Termination

You may stop using the Service and cancel your subscription at any time. We may terminate or suspend access for material breach of these Terms. Upon termination you may request an export of your data within 30 days, after which we may delete it in accordance with our Privacy Policy.

13. Governing law

These Terms are governed by Slovenian law. Any dispute arising from them falls under the jurisdiction of the competent court in Ljubljana, Slovenia.

14. Changes to these Terms

We may update these Terms from time to time. We will post changes on this page and, for material changes, notify account holders by email before they take effect. Continued use of the Service after changes take effect constitutes acceptance.
